Ciao Cosmetic SRL General Conditions
Article 1. Definition
In the following general conditions, the term product is used specifically to mean the following.
Product: The merchandise that, in accordance with the agreement between the Buyer and Ciao Cosmetic SRL, will be delivered to the Buyer within a pre-established time frame, following payment of a pre-established price.

Article 2. Applicability
2.1 Unless in cases where it is expressly otherwise agreed, the cited supply and payment conditions apply to all Ciao Cosmetic SRL offers and contracts.
By placing an order, the Buyer implicitly accepts these conditions, of which he is considered informed.
2.2 Italian Law is applied to all of our contracts. Possible legal cases are subject to the magistrate’s court or the circuit court in which Ciao Cosmetic SRL has its Headquarters (Bergamo, Italy)
2.3. The current conditions are applicable to all of Ciao Cosmetic SRL products.

Article 3. Offers/ Contracts
3.1 All Ciao Cosmetic SRL offers are commitment free until the receipt of an order confirmation from the part of the Buyer. If it were necessary to increase the purchase price of a product in compliance with a legal regulation or judicial ruling, Ciao Cosmetic SRL will make all efforts to inform the Buyer in writing immediately (by E-mail or letter). In that case, the Buyer has the possibility of canceling the stipulated agreement, by sending written notification (by E-mail or letter) to the Ciao Cosmetic SRL address.
3.2. The Buyer who sends an order through the Website must provide a valid e-mail address, to which will be sent a confirmation of the order receipt, in which the following with be specified:
(a) the description of the purchased product and the number of units requested
(b) the total price of the order
(c) the name and address to which the product will be sent.
(d) the indications of our bank for your remittance

Article 4. Payment
Unless otherwise agreed, the owed amount by the Buyer must be paid within five days after the order has been sent. The Buyer will not be able to assert any of the expected rights in relation to the evasion of the order without having paid for the goods. The Buyer has the obligation to immediately inform Ciao Cosmetic SRL of any possible inaccuracies relating to the payment details. In the case that the Buyer doesn’t comply within the established terms of his payment obligation, Ciao Cosmetic SRL will be able to consider the order canceled.

Article 5. Transport
The legal transportation risks of the merchandise ordered by the Buyer are the responsibility of Ciao Cosmetic SRL
They are passed to the Buyer at the moment of delivery.

Article 6. Delivery times
6.1 The maximum estimated delivery time of the merchandise is 20 days from the receipt of the payment.
6.2 In the case of violation, on the part of Ciao Cosmetic SRL, for whatever reason, to complete the agreed delivery, Ciao Cosmetic SRL will make all efforts to inform the Buyer in writing (by E-mail or letter)
6.3 If the Buyer has carried out the payment, thus fulfilling an order that subsequently has been canceled in writing (by E-mail or letter) in accordance with 6.1 of the current General Conditions, Ciao Cosmetic SRL will make all efforts to repay the corresponding amount within 10 days following the receipt of such a cancellation.
6.4 Ciao Cosmetic SRL, still in line with the timing outlined in 6.1. reserves the right to carry out partial deliveries, dispatching orders in two or more consignments, as long as this doesn't increase the cost for the Buyer.

Article 7. Cooling off period
7.1 Within 8 days following the arrival of the ordered merchandise, the Buyer has the right to cancel the purchase agreement with Ciao Cosmetic SRL, without specifying the reason. The merchandise must stay unused and within the packaging unopened.
7.2 In the case that the Buyer wishes to cancel the purchasing agreement in respect of article 7.1 of the current General Conditions, the Buyer must provide written communication (by E-mail or letter) to Ciao Cosmetic SRL. In such cases, the product must be returned to Ciao Cosmetic SRL in its original unopened packaging within and not beyond the 8 days following the arrival of the merchandise to the Buyer.
7.3 In cases of cancelation of the purchasing agreement on the part of the Buyer, carried out in respect of articles 7.1 and 7.2 of the current general conditions, the corresponding purchase price paid will be repaid to the Buyer within 10 days following the arrival of the returned merchandise to Ciao Cosmetic SRL.
7.4 Ciao Cosmetic SRL reserves the right to refuse returned merchandise, or to repay only a part of the price already paid, in cases where the merchandise has been badly damaged by the Buyer.
7.5 In cases where the returned merchandise arrives damaged by handling or negligence ascribable to the Buyer, his forwarding agent, or to whoever the responsibility is ascribable other than the Buyer, Ciao Cosmetic SRL will provide written communication (by E-mail or letter) to the relevant party.

Article 8. Guarantee
8.1 In cases in which Ciao Cosmetic SRL recognizes the validity of a claim, of whatever nature, sent by the Buyer in relation to a bought product, the Buyer has the right to request, from Ciao Cosmetic SRL the replacement of said product with a similar one, or the refund of the entire purchase price.
8.2 The replacement will be carried out within 15 days following the arrival of the merchandise at Ciao Cosmetic SRL, with consignment of the products to the sender without any additional cost.

Article 9. Complaints
9.1 Complaints are sent to Ciao Cosmetic SRL client customer services.
9.2 Ciao Cosmetic SRL guarantees the utmost commitment to resolving complaints within 10 days following their receipt and will provide written communication (by E-mail or letter) to the concerned party.

Article 10. Confidentiality
10.1 Ciao Cosmetic SRL will process and register the personal information of the Buyer in one or more documents, with the sole aim of carrying out the commitments undertaken with said Buyer. This information will also be available for the sending of personalized offers to the Buyer on the condition that the Buyer has previously accepted to receive such offers.
10.2 The personal information used will be strictly limited to that which is provided by the Buyer at the moment of sending the order. The name, E-mail address, and the correspondence sent by E-mail will moreover be saved, in cases where an electronic exchange or correspondence occurs
10.3 In cases in which the Buyer doesn't desire to receive personalized offers from Ciao Cosmetic (newsletters), written communication (by E-mail or letter) to Ciao Cosmetic SRL, will be enough to cancel them. The Buyer also has the option of specifying in a reply to the newsletter.
10.4 Ciao Cosmetic SRL is committed to not providing personal data to third parties.
10.5 The Personal or Business data processed by Ciao Cosmetic SRL in the area of its business activity will be used (amongst other things) for:
a) risk analysis
b) participation in internal and external sector alert systems
c) prevention, detection and tackling of fraud and irregularities.

Article 12. Retention of title
Ciao COSMETIC SRL retains the title of all the products sent to the Buyer, until their similar value has been paid in its entirety to Ciao Cosmetic SRL

Article 13. Force Majeure and/ or Special Circumstances
13.1 Ciao Cosmetic SRL is not required to comply with all the undertaken obligations towards the client, in cases where unexpected obstacles arise. It is not responsible under law, nor judicial proceedings, nor by the most common interpretations and views.
13.2 The circumstances covered in article 13.1 include, amongst others, unexpected operating inefficiencies, power supply failures, or raw material supply failures, transport delays, strikes and unexcused absences, or delays in the supply services.

Article 14 Liability Limitation
Ciao Cosmetic SRL excuses itself from the relative responsibility of unintentionally supplying incomplete or incorrect information

Despite the purity of the ingredients used in Ciao Cosmetic SRL products and the favorable results found in the dermatologic tests, to which they have preventively undergone, theoretically they could, through use, cause minimal side affects. Everyone is individual. Some people will not tolerate certain ingredients because of allergies and intolerances, in the same way that a cosmetic ingredient might not be tolerated by some individuals.
Ciao Cosmetic SRL suggests therefore that the product be tested preemptively on a small area of the skin, but confirms that until now no side effects have been established.
